1. Acceptance of Terms
By using PatchPulse ("the Service"), the user fully accepts these Terms & Conditions ("Terms"). If you do not accept these Terms, do not use the Service. Registering an account and using the scanning tools constitutes binding acceptance of these Terms.
2. Description of the Service
PatchPulse provides free information security analysis tools, including: Website Vulnerability Scanner (port scanning, SSL/TLS analysis, web vulnerability checks, DNS enumeration), Browser Scanner (analysis of information exposed by the browser), VPN Security Checker (VPN configuration check), Data Breach Checker (check for email presence in known breaches).
The Service is provided "as-is" and "as-available", without warranties of any kind, express or implied.
3. Scan Authorization and DNS Verification
3.1 Authorization Requirement
The user declares and warrants that they have legal authorization to scan every domain submitted to the Service. Scanning computer systems without authorization is a crime under art. 615-ter of the Italian Penal Code and equivalent legislation in other jurisdictions.
3.2 Domain Ownership Verification
Before performing any scan, the Service requires verification of domain ownership through the addition of a specific DNS TXT record. This verification constitutes technical proof that the user has administrative access to the domain and is therefore authorized to scan it. The system verifies the presence of the DNS record before each scan.
3.3 User Responsibility
Despite DNS verification, the user remains the sole responsible party for ensuring the scan complies with all applicable laws, including but not limited to: cybercrime laws of their country, terms of service of the target domain's hosting provider, internal corporate regulations (if the domain belongs to an organization), any contractual agreements with third parties.
3.4 Indemnification
The user indemnifies and holds harmless PatchPulse, its developers, administrators and collaborators from any claim, damage, loss, cost, expense (including legal fees) arising from unauthorized use of the Service or violation of these Terms. This indemnification extends to any legal action, claim or proceeding brought by third parties in relation to scans performed by the user.
4. Permitted Use
The Service may be used exclusively to: assess the security of domains you own, perform authorized security audits, educational and research purposes on your own systems.
5. Prohibited Use
It is strictly forbidden to use the Service to: scan domains without the owner's authorization, attempt to circumvent the DNS verification system, perform Denial of Service (DoS/DDoS) attacks, exploit discovered vulnerabilities for illicit purposes, resell or redistribute scan results commercially without authorization, interfere with the operation of the Service or other users, attempt to access other users' data.
Violation of these provisions results in immediate account suspension without notice and possible reporting to competent authorities.
6. Limitation of Liability
PatchPulse is not responsible for: direct, indirect, incidental, consequential or punitive damages arising from use of the Service; the accuracy, completeness or reliability of scan results; Service interruptions, errors or malfunctions; actions taken by the user based on scan results; violations of law committed by the user through the Service.
Scan results are provided for informational purposes and do not constitute a professional security assessment. For complete security audits, we recommend consulting certified professionals.
In any case, PatchPulse's maximum liability shall not exceed any amount paid by the user for the Service (which, being free, is zero).
7. User Account
The user is responsible for the confidentiality of their access credentials. The user must use a strong password (minimum 8 characters, with uppercase, lowercase and numbers) and not share it with third parties. Any activity carried out with the user's credentials is the user's responsibility. In case of unauthorized access, the user must immediately notify [email protected].
8. Intellectual Property
The Service, its source code, design and contents are protected by intellectual property laws. The user does not acquire any intellectual property rights in the Service. Scan results generated for the user's domains belong to the user.
9. Service Availability
PatchPulse reserves the right to: modify, suspend or discontinue the Service at any time, without notice; limit access to the Service for maintenance or security reasons; modify usage limits (rate limiting, number of scans, etc.).
10. Privacy
The processing of personal data is governed by our Privacy Policy, which constitutes an integral part of these Terms.
11. Termination
The user can stop using the Service at any time by deleting their account. PatchPulse may suspend or delete an account in case of violation of these Terms, without obligation of prior notice. Upon termination, all user data is permanently deleted as described in the Privacy Policy.
12. Changes to the Terms
PatchPulse reserves the right to modify these Terms at any time. Changes will be published on this page with the update date. Continued use of the Service after the changes are published constitutes acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by Italian law. For any dispute arising from use of the Service, the competent court is that of Udine, Italy, except as otherwise provided by mandatory consumer protection rules.
14. Severability
If any provision of these Terms is declared invalid or unenforceable, the remaining provisions will remain in full force and effect.
